There is an agreement between Facebook and us as joint controllers in accordance with Art. 26 DSGVO. This agreement stipulates that Facebook itself assumes all data protection obligations in connection with Page Insights.

Page views are summarised data that we, as the operator of a Facebook page, can use to obtain information about how users interact with our page.

This covers in particular the obligations under Articles 12, 13, 15 - 22 and 32 - 34 DSGVO.

2. Explanation of terms

We have designed our privacy policy according to the principles of clarity and transparency. However, if there are any ambiguities regarding the use of various terms, the relevant definitions can be found in the GDPR.

3. Legal basis for the processing of personal data

We only process your personal data, such as your surname and first name, your e-mail address and IP address, etc., if there is a legal basis for doing so. The following regulations in particular come into consideration here according to the General Data Protection Regulation:

  • 6 para. 1 p. 1 lit. a GDPR: The data subject has given consent to the processing of personal data relating to him or her for one or more specific purposes.
  • 6 para. 1 p. 1 lit. b GDPR: Processing is necessary for the performance of a contract to which the data subject is party or for the performance of pre-contractual measures taken at the request of the data subject.
  • 6 para. 1 sentence 1 lit. c GDPR: Processing is necessary for compliance with a legal obligation to which the controller is subject.
  • 6 para. 1 p. 1 lit. d GDPR: Processing is necessary to protect the vital interests of the data subject or another natural person.
  • 6 para. 1 sentence 1 lit. e GDPR: Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
  • 6 para. 1 p. 1 lit. f GDPR: Processing is necessary for the purposes of the legitimate interests of the controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data, in particular where the data subject is a child.

However, at the relevant points in this privacy policy, we will always point out the legal basis on which your personal data is processed.

4. Disclosure of personal data

The transfer of personal data is also processing within the meaning of the previous point 3. However, we would like to inform you again separately here about the subject of transfer to third parties. The protection of your personal data is very important to us. For this reason, we are particularly careful when it comes to passing on your data to third parties.

We therefore only pass on data to third parties if there is a legal basis for the processing. For example, we share personal data with persons or companies that act as processors for us in accordance with Article 28 of the GDPR. A processor is anyone who processes personal data on our behalf - i.e. in particular in an instruction and control relationship with us.

In accordance with the requirements of the GDPR, we conclude a contract with each of our processors to oblige them to comply with data protection regulations and thus to provide comprehensive protection for your data.

5. Storage period and deletion

We store all personal data that you transmit to us only for as long as it is needed to fulfil the purposes for which this data was transmitted or as long as this is required by law. Once the purpose has been fulfilled and/or the legal storage periods have expired, we delete or block the data.

6. TLS encryption

This website uses TLS encryption for security reasons and to protect the transmission of confidential content, such as enquiries that you send to us as the website operator. You can recognise an encrypted connection by the fact that the address line of the browser changes from "http://" to "https://" and by the lock symbol in your browser line.

If encryption is activated, the data you transmit to us cannot be read by third parties.

7. Collection and storage of personal data as well as their type and purpose of use

In the following, we explain the data processing procedures by us. With regard to data processing by Facebook, please refer to their privacy policy https://de-de.facebook.com/policy.php.

a) When visiting the platform

When you call up our Facebook page, information is automatically sent to the server of the platform operator by the browser used on your end device or by the app. This information is temporarily stored by the platform operator in a so-called log file. The following information is collected without your intervention and stored until automatic deletion:

  • IP address of the requesting computer
  • Date and time of access
  • Name and URL of the retrieved file
  • Website from which the access is made (referrer URL)
  • The browser used and, if applicable, the operating system of your computer as well as the name of your access provider.

However, this data is only available to the platform operator. It is not possible for us to access this data. Further information can be found in the platform operator's data protection declaration, see above.

We do not collect any personal data about you. However, it is possible to obtain pseudonymised data in the form of statistics about the users of our site over a certain period of time. The software for analysing user statistics is usually provided by the platform operator itself, but in some cases it is also possible to integrate third-party software (e.g. Google Analytics). Here, data about the users of the site can be collected, such as age, gender, country of origin, browser used and interests.

However, this data is always pseudonymised and it is not possible for us to make statements about individual users based on this data alone. We use this data exclusively to optimise the content we offer and its marketing and to adapt it to the respective user interests. This is a legitimate interest pursuant to Art. 6 para. 1 p. 1 lit. f GDPR.

 

b) When interacting with our account

Furthermore, it is possible for you to interact with our account. You can do this, for example, by marking a post with "Like", sharing or commenting on it or by writing to us directly.

When you interact with us, data processing by us is usually inevitable, as this allows us to see your account and thus makes personal data about you accessible to us; for example, your username, your profile picture or the date or time of the interaction.

We use this data exclusively to optimise the content we offer and its marketing and to adapt it to the respective user interests. This is a legitimate interest pursuant to Art. 6 para. 1 p. 1 lit. f GDPR. Our legitimate interest follows from the above-mentioned reason of optimising the content provided by us on our profile. Furthermore, the data collected is information that is only made available to us through your interaction with our profile. This establishes a relevant and appropriate relationship between you and our profile.

Where deletion is possible by us, personal data will be deleted by us after 28 days at the latest, unless there is a legal basis for further processing beyond this period.

8. Cookies

Cookies are used by Facebook on our Facebook page. Cookies are small data packages that are automatically created by your browser and stored on your end device when you visit our website. These cookies serve to store information in connection with the respective end device used. However, a personal identification of your person is not possible through the cookies.

The data processed by cookies is necessary for the aforementioned purposes to protect our legitimate interests as well as those of third parties in accordance with Art. 6 para. p. 1 lit. f GDPR.

Most browsers automatically accept cookies due to the browser default setting. However, you can configure your browser in such a way that either no cookies are stored on your end device or at least a notice is displayed before a new cookie is stored. If you completely deactivate the cookie function in your browser, you may not be able to use all the functions of our website.

Below we explain the different types of cookies we use.

a) Session cookies

In order to make the use of our offer more pleasant for you, Facebook uses so-called session cookies to recognise that you have already visited individual pages of our Facebook site.

These session cookies are automatically deleted after you leave Facebook.

b) Temporary cookies

Facebook also uses cookies that allow us to recognise you when you visit our Facebook page again and use our services. This means that you do not have to repeat the entries and settings you made the last time.

These temporary cookies are stored on your end device for a certain period of time specified by Facebook.

c) Cookies for optimisation purposes

Finally, Facebook also uses cookies for optimisation purposes. These statistically record the use of Facebook and our Facebook page and are evaluated for the purpose of optimising the offer for you. The cookies enable your internet browser to be recognised when you revisit Facebook and/or our Facebook page.

These cookies are automatically deleted after a period of time defined by Facebook.

9. Rights of the data subject

You have the following rights:

a) Information

In accordance with Art. 15 GDPR, you have the right to request information about your personal data processed by us. This right to information includes information about

  • the processing purposes
  • the categories of personal data
  • the recipients or categories of recipients to whom your data have been or will be disclosed
  • the planned storage period or at least the criteria for determining the storage period
  • the existence of a right to rectification, erasure, restriction of processing or objection
  • the existence of a right of appeal to a supervisory authority
  • the origin of your personal data, if it has not been collected by us
  • the existence of automated decision-making, including profiling, and, if applicable, meaningful information on its details

c) Deletion

In accordance with Art. 17 GDPR, you have the right to request the immediate deletion of your personal data from us, insofar as the further processing is not necessary for one of the following reasons:

 

  • the personal data are still necessary for the purposes for which they were collected or otherwise processed
  • on the exercise of the right to freedom of expression and information
  • for compliance with a legal obligation which requires processing under the law of the European Union or the Member States to which the controller is subject, or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller
  • for reasons of public interest in the area of public health pursuant to Art. 9 (2) (h) and (i) and Art. 9 (3) GDPR
  • ffor archiving purposes in the public interest, scientific or historical research purposes or statistical purposes pursuant to Article 89(1) of the GDPR, insofar as the right referred to in Section a) is likely to render impossible or seriously prejudice the achievement of the purposes of such processing
  • for the assertion, exercise or defence of legal claims

  • We no longer need the personal data for the purposes of processing, but you need it to assert, exercise or defend legal claims.
  • You object to the processing pursuant to Art. 21 (1) GDPR.

h) Objection

Insofar as your personal data is processed on the basis of legitimate interests pursuant to Art. 6 (1) p. 1 lit. f GDPR, you have the right to object to the processing of your personal data pursuant to Art. 21 GDPR, insofar as there are grounds for doing so that arise from your particular situation or the objection is directed against direct advertising. In the latter case, you have a general right of objection, which will be implemented by us without specifying the particular situation. If you would like to make use of your right of revocation or objection, it is sufficient to send us an e-mail.
